Disclaimer: Telemedicine Consultation 

Sekhmet Technologies Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at Plot No. 7, 2 Bays, Sector 32, Institutional Area, Gurgaon – 122001, Haryana, India, (“Company” or “we” or “our” or “us”) owns and operates “Clinytics”(“Platform”). The Platform has been developed by the Company for the sole use by certain doctors (“Doctor(s)”) to provide for telemedicine consultations to the users of the Platform through audio and video means.  The Company shall not be liable to any person in case of any unauthorised installation, access or use of this Platform.

Telemedicine consultation via audio, video and text based options have been made available due to the unprecedented lockdown imposed by various Governments in light of which patients are unable to reach hospitals / clinics for in-person consultations. This Platform will continue to be available post the said lockdown, in compliance with the guidelines issued by Ministry of Health and Family Welfare, Government of India, available here: https://www.mohfw.gov.in/pdf/Telemedicine.pdf

A telemedicine consultation has limitations, including that the Doctor is unable to physically examine you. You are therefore advised to confirm any diagnosis, treatment and/or prescription at the earliest opportunity available by visiting a clinic/ hospital for a physical consultation. In any event, in case your symptoms and/or your condition does not improve, you should immediately consider visiting the nearest hospital/ clinic. 

By accepting the terms of a telemedicine consultation and participating therein, you consent to such consultation agree and acknowledge the limitations of such consultation. Doctors and all personnel directly or indirectly involved with any part of the telemedicine consultation process shall not be held responsible in the unlikely event of an error in diagnosis or management due to the occurrence of sub optimal technical conditions. 

You shall be responsible for accuracy of all information required by a Doctor, including disclosure of all relevant facts pertaining to the consultation. Doctors shall not be responsible for accuracy of telemedicine consultation, limited in its scope as it is, with no physical examination of the patient being possible and unless all information is disclosed to the Doctor in a timely and detailed manner. 

We do not control or endorse the content, messages or information provided to you by the Doctor while availing the telemedicine services via the Platform. Therefore, we specifically disclaim any liability with regard to the telemedicine services and any actions resulting from your participation in the telemedicine services, including any liability arising out of misuse of the Platform, and you agree that you waive any claims against us relating to the same, and to the extent such waiver may be ineffective, you agree to release any claims against us relating to the same, except to the extent of our gross negligence. 

The Platform will not record any video or audio generated through the telemedicine consultations. The Platform will maintain a log of your bookings, consultation, video duration, medical history as provided by you, e-prescriptions, if any, along with any data as provided by the Doctor.
